The petitioners apprehend their arrest in Sahar P.S. Case No.88 of 2016 registered under Sections 304B and 34 of the Indian Penal Code.

The mother of the deceased alleged that her daughter was married to Bhim Singh, son of Sukan Singh of village Ekbari in the year 2010 but after marriage, her daughter was always tortured due to non-fulfillment of additional demand of dowry. She further alleged that on 23.08.2016, Bhim Singh and his other family members strangulated her daughter to death. The learned counsel for the petitioners submits that petitioner is married sister-in-law and her husband. No specific

Patna High Court Cr.Misc. No.63728 of 2017 (2) dt.12-01-2018 allegation is made against the petitioners. The marriage was solemnized in the year 2010. The petitioners are living in their own house and they have no manner of concern with the family affairs of deceased and her husband. Sukan Yadav, father-in-law and Asha Devi, mother-in-law have already been granted anticipatory bail by the order passed in Cr. Misc. No.10943 of 2017 and Cr. Misc. 52734 of 2017. The case of the petitioners stands on better footing.

Considering the facts aforesaid and the fact that the petitioners are married sister-in-law and husband of sister-in-law of the deceased, the petitioners above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. X, Bhojpur, Ara in connection with Sahar P.S. Case No.88 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
