Submission of the learned counsel for the petitioners is that petitioner no.1 above named has surrendered in order to pray for regular bail, hence the application against the petitioner no.1 is dismissed as withdrawn.

So far petitioner no.2 is concerned, he is apprehending his arrest in connection with Karakat P.S.Cse No.173 of 2019 registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 506 of the Indian Penal Code and Sections 25(1-b)a, 26 and 27 of the Arms Act.

As per FIR, petitioner no.2 is said to have fired cuasing injury to the informant.

Patna High Court CR. MISC. No.66820 of 2019(3) dt.23-10-2019 2/2 Submission of the learned counsel for the petitioners is that the injuries are simple in nature and the occurrence took place due to altercation between the children of the parties. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, this application is disposed of with direction to the petitioner. If they surrender and make prayer for regular bail, the same will be considered by the learned court below on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day.

With the aforesaid direction, this application is dismissed.
