JUSTICE ARUN KUMAR ORAL ORDER 10-08-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody since 21.6.2018, seeks bail in Baniapur PS Case No. 182 of 2018 registered under Sections 341, 323, 302, 379, 504 and 506/34 of the IPC.
The allegation in brief is that on account of land dispute there was quarrel between father of the informant and the accused persons and accusation is that Alok Kumar Singh, Chandan and Jitesh pin down father of the informant and assaulted with lathi and danda standing on his chest as a result of which he died. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated on account of land dispute, there is no specific accusation against the petitioner of assaulting the deceased rather the same is against Alok and Jitesh, however father of the informant died due to heart failure as per post mortem report when no antimortem injuries were fond over his body either external or internal.\ Whereas learned Counsel appearing on behalf of the informant opposed the prayer for bail.
Patna High Court Cr.Misc. No.49254 of 2018 (2) dt.10-08-2018 Having considered the aforesaid facts and circumstances, the petitioner, namely, Nitesh Kumar Singh @ Babu is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM XI, Chapra at Saran in connection with Baniyapur PS Case No. 182 of 2018.
