JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-09-2019 The learned counsel for the petitioner has drawn attention of this Court to the notice dated 21.08.2018 issued by the Circle Officer, Udawantnagar, District Bhojpur to the private respondents no. 5 and 6, whereby and whereunder they had been directed to submit their show cause reply as to why encroachment in question made over the public land be not removed, however, it is submitted that no action is being taken by the Circle Officer, Udawantnagar, District Bhojpur, after issuance of the said notice.

If that be so, this Court is of the view that the Circle

Patna High Court CWJC No.19707 of 2019(2) dt.24-09-2019 2/2 Officer, Udawantnagar, District Bhojpur is required to take to its' logical conclusion, the aforesaid proceeding initiated by issuing notice dated 21.08.2018, in accordance with the provisions contained in the Bihar Public Land Encroachment Act, 1956. It is directed accordingly.

The writ petition stands disposed of on the aforesaid terms.
