2. The petitioner seeks regular bail in connection with Chandauti P.S. Case No.360 of 2022, lodged on 31.08.2022, under Section 395 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against five unknown accused persons. Name of the petitioner has figured in this case by virtue of confessional statement of co-accused Ravindra Paswan.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence.
Patna High Court CR. MISC. No.73150 of 2024(3) dt.18-01-2025 2/3 Counsel submits that there are two criminal antecedents against the petitioner in which he is on bail. Counsel submits that co-accused Ravindra Paswan has been granted bail vide order dated 06.12.2023 passed in Cr. Misc. No.64051 of 2023. He submits that bail may be granted to the present petitioner on the same condition on the basis of which bail was granted to co-accused Ravindra Paswan.
5. Learned Counsel for the State opposes the prayer for bail and fairly submits that bail was granted to coaccused Ravindra Paswan on the condition that he shall be released on bail after framing of the charge as well as on being satisfied that he is not absconding in all the pending cases.
6. In the present facts and circumstances of this case and the submissions made above, let the petitioner, above named, be granted bail only after framing of the charge, if not framed, as well as on being satisfied that petitioner is not absconding in the following cases, i.e., (i) Bodhgaya (Cherki) P.S. Case No.520 of 2022 and (ii) Magadh Medical P.S. Case No.35 of 2018, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial
