The petitioners apprehend their arrest in connection with Obra P.S. Case No. 197 of 2019 registered under Section 307 and other allied Sections of the Indian Penal Code. The accusation is that due to land dispute, six persons named in the F.I.R. including the petitioners having armed with Bhala, Garasa, sword and iron rod came in the field of the informant , Ruplal Paswan and started to abuse and cause assault to him. At that time, they snatched the gold chain from his wife. In the meantime,

Patna High Court CR. MISC. No.64007 of 2019(2) dt.18-10-2019 2/2 Rajesh Ram (petitioner no.4) gave sword blow at the head of informant and Dhirendra Ram (petitioner no. 3) caused injury to his sister, Sumitra Kunwar.

Learned counsel for the petitioners submits that occurrence took place due to land dispute, in which, petitioners' side also sustained injury, regarding which, Obra P.S. Case No. 196 of 2019 is also instituted on the basis of Fradbeyan of co-accused, Nandlal Ram. Moreover, the injury, as found on the person of the sister of the informant, is simple in nature whereas the nature injury, as found on the person of the informant, is kept reserved. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned S.D.J.M., Aurangabad, in connection with Obra P.S. Case No. 197 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
