Petitioner is apprehending his arrest in connection with Araria P.S.Case No.717 of 2018 , registered for offences punishable under Sections 341, 323, 325, 379/34 of the Indian Penal Code.

As per FIR, there is allegation that while the informant was returning, the petitioner and 5-6 other accused persons started demanding money from him and snatched Rs.4,000/-. Submission of the learned counsel for the petitioner is that there is delay of four days in lodging FIR, which has not been explained and whereas during investigation has not supported the case. Further submission is that he has no

Patna High Court CR. MISC. No.62620 of 2019(4) dt.09-01-2020 2/2 criminal antecedent and he has falsely been implicated in this case . He is ready to abide by any condition imposed upon him. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Araria in connection with Araria P.S.Case No.717 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

Accordingly, this application is allowed.
