The petitioners apprehend their arrest in Singheshwar P.S. case No. 115 of 2017 under Section 302, 201/34 of the Indian Penal Code.
The father of the deceased alleged that his daughter was married to Kuldeep Ram but her husband and other in-laws were torturing her. His daughter also filed complaint case No. 1324 of 2010 against Sahdeo Ram, Musharni Devi, Lallan Ram and others but thereafter the accused persons strangulated his daughter to death on 26.05.2017 and hurriedly cremated her dead body.
The learned counsel for the petitioners submits that
Patna High Court Cr.Misc. No.63379 of 2017 (2) dt.11-01-2018 2/2 petitioners are brother-in-law and sister-in-law of the deceased. They are living separately and they have no manner of concern with the family affairs of the deceased and her husband. The marriage was solemnized in the year 2004. The deceased died her natural death in the year 2017.
Considering the facts that the marriage was solemnized in the year 2004 and the deceased died in the year 2017 but no specific allegation is made against the petitioners, who are brother-in-law and sister-in-law of the deceased, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Singheshwar P.S. case No. 115 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
