The petitioner is in custody since 21.03.2018 in connection with Gaya Civil Lines P.S. Case NO. 374 of 2017 for the offence registered under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the present petitioner is not named in the first information report but has been remanded in connection with the present case when he was in custody in connection with Gaya Kotwali P.S. Case No. 72 of 2018. It is further submitted that even pursuant to his remand, he has neither been placed on T.I. Parade nor has any

incriminating article been recovered from his possession. It is further submitted that save and except suspicion, there is no further material against the petitioner so as to implicate him in connection with the present case.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class- Gaya in connection with Gaya Civil Lines P.S. Case No. 374 of 2017, subject to the following conditions :-

(1) One of the bailors will be his father.

(3) The petitioner shall remain physically present in Court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons his bail bonds shall be liable to be cancelled by the learned Court concerned.

(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to

move for cancellation of bail.
