The petitioner, already in custody, seeks bail in connection with Kahalgaon P.S.Case No. 68 of 2018 registered under Sections 395 and 397 of the Indian penal Code. Submission is that FIR is against unknown and two days after the occurrence, case was instituted and only material transpired against the petitioner during investigation is disclosure of his name by Anupam Kumar Singh and Ramesh Kumar but these two co-accused have been admitted to bail by this Court as well as by co-ordinate Bench of this Court respectively.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Nitish Kumar is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two
Patna High Court Cr.Misc. No.48702 of 2018(2) dt.07-08-2018 2/2 sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I, Bhagalpur in connection with Kahalgaon P.S. Case No. 68 of 2018.
