Mr. Sri Bharat Bhushan ======================================= CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-09-2018 The petitioner seeks bail in connection with Mairwa P.S. Case No. 125 of 2018 dated 10.04.2018 instituted for the offences under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a), 38(i), 41(i) of the Bihar Prohibition & Excise Act, 2016.

Huge quantity of liquor is said to have been recovered from behind the house of one Jai Ram Singh. The learned counsel for the petitioner has submitted that from the seizure list itself, it would appear that nothing has been recovered from the

Patna High Court Cr.Misc. No.54613 of 2018(2) dt.04-09-2018 2/2 possession of the petitioner; rather everything has been recovered from and around the house of aforesaid Jai Ram Singh. The petitioner has been made accused in this case because he happened to go to the house of Jai Ram Singh at the time when when the raid was conducted.

The petitioner is in custody since 11.04.2018 and does not have any criminal antecedent.

Regard being had to the aforestated facts, the petitioner, above named is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judgecum-Special Judge, Excise, Siwan in connection with Mairwa P.S. Case No. 125 of 2018.
