JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This application, for grant of anticipatory bail, arises out of Danapur P.S. Case No. 816 of 2018, disclosing offences under Sections 420, and 406 of the Indian Penal Code. Allegation as per F.I.R. is that petitioner had taken a loan of Rs. Twelve Lakhs from the informant and for that he has issued three cheques and that cheques on production before the bank bounced.

Submission of learned counsel for the petitioners is that in spite of allegation, no case under section 138 N.I. Act has been filed rather case has been filed under Section 406 and 420 of the Indian Penal Code and he is resident of Rupaspur and he has land there, for which, there was talk of sale of land and informant is brother but the same could not materialize, in spite

He is a doctor and has residential property within the jurisdiction of the civil court and there is no chance of tampering with the evidence. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additonal Chief Judicial Magistrate -I, Danapur, Patna, in connection with Danapur P.S.
