The petitioner apprehends her arrest in connection with Sandesh P.S. Case No.75 of 2022, registered for the offences punishable under Sections 406, 420, 467, 468 and 34 of the Indian Penal Code.

The prosecution case, in brief, is that on 29.01.2022, during on going drive against illegal mining, a truck was seized by the informant on account of carrying load more than what was indicated in the e-challan. Thereafter on 06.04.2022, a release order was produced by the driver of the said truck before the police, which was found to be forged by the Mines Department.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as

It is further submitted that the petitioner is the owner of the said truck and she has already deposited Rs.2,40,313/- in the Mines Department, in support of which, learned counsel for the petitioner produced a photo copy of letter dated 06.07.2022 showing deposit of the said amount.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts aforesaid, let petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhojpur at Ara/concerned court in connection with Sandesh P.S. Case No.75 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
