2. The petitioners have prayed for regular bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.
3. As per the prosecution case, this is a case of last
Patna High Court CR. MISC. No.72276 of 2024(7) dt.02-04-2025 2/3 seen and the deceased was said to have been called by Mohammad Alauddin and Jahur Alam. The name of these petitioners is not in the FIR. Their name has surfaced in the statement of Raushan Ara. Raushan Ara has stated that her son was taken away by Alauddin and Jahur. She has further stated that these petitioners along with others were there in the conspiracy.
4. Learned counsel for the petitioners has submitted that except the suspicion of Raushan Ara, there is nothing against these petitioners. It has also been submitted by the learned counsel that the learned Co-ordinate Bench has granted bail to one Jahur Alam who is alleged to have taken away the son of the informant. The case of these petitioners is on better footing. The petitioners are in custody since 07.08.2024.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Purushottampur P.S. Case No. 72 of 2023 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each of them with two
