Petitioner seeks bail in a case registered for the offences punishable under Sections 109 and 306 of the Indian Penal Code.
Submission is that a bare perusal of the FIR would reveal that commission of suicide by wife and daughter of the petitioner was not result of any abetment caused by the petitioner. Since wife of the petitioner had put herself on fire due to quarrel with the petitioner, the same cannot be considered as a case of abetment by the petitioner.
Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.65454 of 2019(3) dt.03-12-2019 2/2 satisfaction of learned Court below where the case is pending in connection with S.T. No. 119 of 2019 arising out of Kochadhaman (Bishanpur O.P.) Police Station Case No. 105 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
