The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 323, 324, 325, 307/34 of the Indian Penal Code.
As per the prosecution case, on the alleged date and time of occurrence, all the FIR named accused persons including petitioners having armed with lathi, danda, Rami and Farsa assaulted the informant and his son causing injuries to them.
It is submitted that allegation of assault is general and omnibus. Injuries caused by the petitioners found to be simple
Patna High Court CR. MISC. No.69649 of 2022(2) dt.05-05-2023 2/2 in nature by the doctor. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Bhojpur, Ara in connection with Jagdishpur P.S. Case No. 55 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
