This application has been filed for directing the respondent authorities to register First Information Report on the written complaint made by the writ petitioner dated 12.09.2019 sent through registered post. Further directing the respondent authorities in PhulwariSharif Police Station to grant protection to petitioner's life and property from the group of anti-social persons/criminals led by respondent no.8 who used

Patna High Court CR. WJC No.1471 of 2019(5) dt.04-05-2023 2/3 to threatened and terrorize the petitioner and her family since several years. However, local police is not taking any action against them under political pressure.

The Station House Officer of Phulwarisharif police station has appeared. Learned counsel for the State has informed that the F.I.R. has been registered. It is expected that the investigation of the case is concluded at the earliest preferably within three months. The petitioner has grievance that the offence is made out under some more sections which has not been mentioned in the F.I.R. The petitioner is given liberty to file a representation before the Station House Officer, Phulwarisharif for addition of those sections and if the Station House Officer finds that the offences under those sections have made out then he will file an application in the court of learned Magistrate for addition of those offences. If the Station House Officer does not act on the application filed by the petitioner then the petitioner has liberty to move the court of the Magistrate in view of the law laid down by Hon'ble Supreme Court in the case of Sakiri Vasu Vs. State of UP AIR 2008 SC 907.

Learned counsel for the petitioner has submitted that he being unnecessarily harassed and the police and the Circle

WJC No.1471 of 2019(5) dt.04-05-2023 3/3 Officer, Anchal Phulwarisharif may be directed to intervene in the matter in the Janta Darbar held in the Police Station on every Saturday in which the Officer-in-Charge and Circle Officer are present. If the petitioner approaches the Officer-in-Charge and Circle Officer, Phulwarisharif for redressal of his grievances, then they will try to resolve the issue in accordance with law. With the aforesaid observation and direction, this application is disposed of.
