2. This is the second attempt of prayer of bail by the petitioner earlier his prayer was rejected vide order dated 30.01.2023 passed in Cr. Misc. No. 61269 of 2022 for the present.
3. The petitioner has prayed for regular bail in a case instituted for the offence under Sections 147, 149, 341, 323, 354A, 307, 379, 427, 504 of the Indian Penal Code.

4. The allegation against the petitioner and other coaccused persons is that they uprooted the crop and three from the land of the informant. It is further alleged that when the informant reached there and raised protest, the petitioner along with others assaulted the informant and his family members due to which they sustained injury.
5. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. There is admitted land dispute between the parties. There is a case and counter case between the parties. He further submitted that the other co-accused has already been granted bail by this Bench vide order dated 06.11.2023 passed in Cr. Misc. No. 46808 of 2023 and the case of this petitioner stands on better footing. He is languishing in judicial custody since 16.06.2022.
6. The application for bail is opposed by learned APP for the State and learned counsel for the informant.
7. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail after framing of charge, if not framed. The above named petitioner is directed to be enlarged on bail on furnishing
Patna High Court CR. MISC. No.71199 of 2023(2) dt.28-11-2023 3/3 bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.D.J-V, Katihar in connection with Barari P.S. Case No. 16 of 2021.
