2. The petitioner seeks bail in a case registered for the offence punishable under Section 69 of the B.N.S. & under sections 3(2) (va) of the SC/ST Act and later on u/s 4/6 of the POCSO Act has been added.
3. The allegation in the First Information Report is that the petitioner made physical relationship with the informant on the pretext of false promises of marriage whereafter informant/victim became pregnant and thereafter the marriage was denied.
4. Learned counsel for the petitioner submits at the outset that it is not a case of any caste based abuses and hence

Further the age of the informant/victim is evident from her fardbeyan itself which is 20 years and hence the offence under POCSO Act would also not be made out. It is further pointed out that the informant has herself admitted that she was in a love relationship with the petitioner and her physical intimacy with the petitioner was within the knowledge of her mother and sister. The petitioner is in custody since 23.06.2025 and the charge-sheet has been submitted. The petitioner is a young man with no criminal antecedent.
5. Learned APP for the State and learned counsel appearing on behalf of the informant vehemently opposed the grant of bail. Learned counsel for the informant submits that the petitioner had established relationship with the informant on the false pretext of marriage and has left her in lurch as she also became pregnant and subsequently delivered a child but the petitioner has denied marriage. He has also submitted that as per her educational certificate the informant is still a minor and that is the reason charge-sheet has been submitted under the POCSO Act.
6. Taking into consideration the rival contentions and also considering the facts that entering into a love relationship
Patna High Court CR. MISC. No.70518 of 2025(3) dt.17-11-2025 3/3 along with physical intimacy was a conscious and informed choice of the informant/victim who is a major, coupled with the fact that that the petitioner has remained in custody since 23.06.2025 with no criminal antecedent and charge-sheet has already been submitted, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor Court in connection with Govindganj P.S. Case No. 67 of 2025, subject to the following conditions:- (i). One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife. (ii) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
