This application for anticipatory bail arises out of Sahebpur Kamal P.S. Case No. 411 of 2017 for the offences under Section 341, 323, 324, 326, 307, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act.
Learned counsel for the petitioners has drawn my attention to an order of this Court dated 09.07.2018, passed in Criminal Miscellaneous No. 26064 of 2018, whereby coaccused Vimal Yadav @ Kumod Kumar has been granted privilege of Anticipatory Bail. He contends that the accusation against the petitioners is similar and as has been noticed by the co-ordinate Bench in the order dated 09.07.2018, after going
Patna High Court Cr.Misc. No.49540 of 2018(2) dt.20-09-2018 2/2 through the case diary, that the injuries on the informant have been found to be simple in nature. The petitioners do not have any criminal antecedent as stated in the application. Considering the nature of accusation and submissions advanced on behalf of the petitioners, this application is allowed.
Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate - V, Begusarai in Sahebpur Kamal P.S. Case No. 411 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
