JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 The petitioner seeks regular bail in connection with Barauni (Chakia) P.S. Case No. 35/2019, registered for offences punishable under Sections 392 of the Indian Penal Code. Prosecution case is that while the informant was coming with his father from Thermal Halt Chakiya Railway Station by motorcycle and when he reached near the Thakurbari, three miscreants came and snatched away his motorcycle, two mobile phones. Later on the name of petitioner transpired in this case on the confessional statement of co-accused and his confession was also recorded and chargesheet has been submitted under Sections 395 and 397 of the Indian Penal Code. It has been submitted on behalf of the petitioner that he has been in custody for last six months but uptil now, he has not been put on Test Identification Parade and chargesheet has

Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni (Chakia) P.S. Case No. 35/2019 subject to the condition that petitioner has to appear before the Officer-in-Charge of the police station of his area in the first week of each month for a period of six months so that the police may watch his conduct during that period.
