1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Maheshkhunt P.S Case no. 80 of 2022 registered under sections 307, 341, 323, 427 and 34 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, it is stated by the informant that while he was returning home, the accused persons had gathered variously armed. It is stated that on the orders of Shekhar Yadav, Ajay Yadav fired hitting the informant in his left leg. Further Shekhar Yadav also resorted to firing but the shot missed the informant.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The

Patna High Court CR. MISC. No.73861 of 2023(2) dt.29-11-2023 2/2 allegation is general and omnibus in nature. His case stands on a better footing than co-accused Ajay Yadav, who has been enlarged on bail vide order dated 05.07.2023 passed in Cr. Misc no. 36991 of 2023. The petitioner is in custody since 18.7.2023 and charge-sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, there being no direct allegation against this petitioner of having resorted to firing, grant of bail to co-accused Ajay Yadav, the petitioner having remained in custody since 18.07.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Maheshkhunt P.S Case no. 80 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Khagaria.
