The petitioners seek bail in connection with

Patna High Court CR. MISC. No.71224 of 2024(3) dt.21-11-2024 2/3 Koilwar P.S. Case No. 293 of 2024 instituted for the offence under Sections 310(2) of the Bharatiya Nyaya Sanhita, 2023. 3.

Allegation against the petitioners is of snatching the bag of the informant containing Rs. 4,35,000/- (Four lakhs and thirty five thousand).

It has been submitted on behalf of the petitioners that the petitioners are in custody since 04-08-2024. Petitioners bear no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioners' counsel that petitioners have been falsely implicated in the present case. Petitioners are not named in the FIR. Name of the petitioners have transpired during course of investigation followed by their self confessional statements. No incriminating article has been recovered from the conscious possession of the petitioners. Petitioners were not put on T.I. Parade. There is no independent witnesses to the occurrence.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners. It is fervently submitted that petitioners in their confessional statement have confessed their guilt.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.71224 of 2024(3) dt.21-11-2024 3/3 of the case, nature of allegation and taking into account materials available on record, this Court, at this stage, is not inclined to grant bail to the petitioners. Prayer is accordingly rejected.

The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and unnecessary adjournments.
