The petitioner apprehends his arrest in connection with Khodawandpur P.S. Case No.87 of 2022 registered under Sections 341, 323, 325, 326, 307, 379, 504, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case due to ulterior motive. He has committed no offence as alleged in the F.I.R. The petitioner has got no criminal antecedent.

Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner stating that the allegation of assault with the butt of the pistol on the informant causing head

Patna High Court CR. MISC. No.70235 of 2022(4) dt.28-03-2023 2/2 as well as hand injuries is specific against the petitioner which is corroborated by the injury report. He further submits that the petitioner is also alleged to have snatched the mobile of the informant.

Therefore, the petitioner does not deserve anticipatory bail.

Having considered the above facts and circumstances of the case, the nature of allegations made against the petitioner and the injury report, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for bail is rejected.
