2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The case of the prosecution is that the father of the informant was sitting at his poultry farm. in the meantime, three unknown miscreants came and demanded 2 kg chicken and when his father told him that chicken is not being sold here, one miscreant shot the father of the informant due to which his father sustained fire arm injuries. Thereafter, the accused persons fled away towards Dalsinghsarai. During treatment, the father of the informant died.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.68160 of 2025(2) dt.24-09-2025 2/3 petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. During course of investigation, one Sonu Kumar has given his confessional statement and the name of this petitioner has surfaced on the basis of confessional statement of co-accused Sonu Kumar. It has further been submitted that other co-accused persons have already been granted bail by learned co-ordinate Benches of this Court vide order dated 29.11.2024, 21.04.2025 and 23.09.2024 passed in Cr. Misc. Nos. 65490 of 2024, 89119 of 2024 and 50907 of 2024. The case of this petitioner stands on similar footing. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 19.05.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dalsinghsarai P.S. Case No. 419 of 2023 on furnishing bail
