JUSTICE SANJAY PRIYA ORAL ORDER 2/ 03-10-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in S.T. No.203 of 2018 arising out of Morkahi P.S. Case No.32 of 2018 instituted for the offence under Section(s) 25(1-B)a, 26, 35, 1(a), 1(AA) of the Arms Act.

Counsel for the petitioner submits that from the seizure list it is apparent that recovery has been made from the house of Md. Ashraf. The petitioner has been arrested from the house and thereafter seizure list has been prepared. Counsel for the petitioner further submits that petitioner is relative of Md. Asraf. There is no recovery of any incriminating article from his conscious possession.

Firoz, have already been granted bail by co-ordinate Benches of this Court vide order dated 19.07.2018 passed in Cr. Misc. No 42575 of 2018 and order dated 28.09.2018 passed in Cr. Misc. No.55900 of 2018 respectively. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the I/c Sessions Judge, Khagaria, in connection with S.T. No.203 of 2018 arising out of Morkahi P.S. Case No.32 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
