In this case, the petitioners are apprehending their arrest in connection with Imamganj P.S. Case No. 75 of 2019 registered for offences under sections 147, 148, 149, 341, 323, 333, 337, 353, 504, 506 of the Indian Penal Code. As per prosecution case, on receipt of information of illegal construction work, the Informant, namely, A.S.I. Murari Paswan along with armed forces, went to the place of occurrence and tried to stop the same whereupon the petitioners
Patna High Court CR. MISC. No.68451 of 2019(4) dt.06-03-2020 2/3 stated pelting stones upon the police party causing damage to the vehicle as also causing injury to them.
For the same offence, another criminal case has also been lodged bearing Imamganj P.S. Case No. 76 of 2019 registered by Sonia Devi.
Learned counsel for the petitioners submits that other co-accused persons have been granted privilege of anticipatory bail vide order of this Court dated 27.11.2019 passed in Cr. Misc. No. 71772 of 2019.
The case diary does not show any specific allegation having been made against the present petitioners. Looking to the entire facts and circumstances of the case as also there being no specific allegation against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati, Gaya in connection with Imamganj P.S. Case No. 75 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for

No.68451 of 2019(4) dt.06-03-2020 3/3 investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled. It is made clear that after release on anticipatory bail, the petitioners will report to the Imamganj police station by 7th of every month for at least six months and in case of failure without any valid rhyme or reason, the anticipatory bail granted to the petitioners will be treated to have been canceled.
