The petitioner has been in custody since 12.08.2017 in connection with Basantpur P.S. Case No. 270/17 registered for the offences punishable under Sections 399/402 of the Indian Penal Code and Section 25(1-b)A/26/35 of the Arms Act. Learned counsel for the petitioner submits that on the basis of secret information, four persons including the petitioner were arrested. However, there is no recovery from the conscious possession of the petitioner and there is nothing on record to show that they had gathered together to commit any dacoity. Considering the facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.
