Petitioner, already in custody since 20.03.2017, seeks bail in connection with Rajoun P.S. Case No.227 of 2016 registered under Sections 147, 149, 314, 323, 307 and 302 Indian Penal Code.
Learned counsel for the petitioner submits that the FIR was lodged after seven days from the date of alleged occurrence and after thought this falsely case ws levelled due to land dispute as both are agnates and after one and half months of the alleged occurrence, informant died. Further, learned counsel seeks bail on the ground of parity as Sunil Yadav and Akshay Yadav were admitted to bail by a co-ordinate bench of this Court vide Cr. Misc. No. 32085 of 2018 and petitioner has no
Patna High Court Cr.Misc. No.49675 of 2018(2) dt.10-08-2018 2/2 criminal antecedent except one case under Sections 323, 341, 379, 452, 527 and 504 of IPC.
Having considered the aforesaid facts and circumstances, petitioner Pintu Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Banka in connection with S.Tr. No. 345 of 2017 arising out of Rajoun P.S. Case No.227 of 2016 with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
