JUSTICE SANDEEP KUMAR ORAL ORDER 24-11-2023 This is the second attempt of the petitioner for grant of bail as the earlier application of the petitioner has been rejected vide order dated 30.01.2023 passed in Cr. Misc. No. 42409 of 2022.

2. Heard the learned counsel for the petitioner and learned APP for the State Shri Satya Nand Shukla.

3. The petitioner seeks bail in connection with Sessions Case No. 345 of 2022 arising out of Singheshwar P.S. Case No. 29 of 2019 registered for the offence under Sections 498A, 494, 328, 302/34 of the Indian Penal Code.

4. As per the prosecution case, it is alleged that the petitioner has killed the deceased.

5. Learned counsel for the petitioner submits that the petitioner who is the husband of the deceased is innocent and has falsely been implicated in this case.

6. Learned counsel for the petitioner further submits that there is no progress in trial till date and the petitioner is behind bars since 14.05.2020.

7. Learned A.P.P. has vehemently opposed the prayer for bail.

8. Considering the aforesaid facts and the period of custody, this application for regular bail is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI, Madhepura in connection with Sessions Case No. 345 of 2022 arising out of Singheshwar P.S. Case No. 29 of 2019.
