JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-04-2024 The present writ petition has been filed seeking the following reliefs:- "1(A). Writ in the nature of Certiorari or any other appropriate writ / writs, order / orders, for quashing the letter containing Memo No. 2033 dated 15.09.2022 issued by the Respondent No. 4 the District Commandant, Home Guard, East Champaran, Motihari, whereby and whereunder the Respondent No. 3 asked show cause as to why the candidature of the petitioner be not cancelled (Annexure -4).

A Writ in the nature of Mandamus or any other appropriate writ / writs, order / orders, direction commanding the respondent for the following:- (i). To consider the candidature of the petitioner considering the fact that the name of the petitioner in provisional list and the Respondent No. 4 asked show cause as to why the petitioner has wrongly stated in Column No. 7 of Form "G" No.

(ii). To appoint the petitioner on the post of "Home-Guard" considering the fact that the petitioner fulfilled entire eligibility for the appointment on the post of Home Guard and his name appears in the provisional merit list."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to file reply to the show cause notice dated 15.9.2022, issued by the Respondent No. 4, i.e. the District Commandant, Home Guard, East Chamaparan, Motihari. Liberty, so sought, is granted.
