====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 06-08-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 28.5.2018, seeks bail in Kotwali PS Case No. 359 of 2017 registered under Section 414 of the IPC.

The allegation in brief is that the police reached at the place of occurrence after receiving information that some accused persons have kept stolen battery and generator machine in their house, apprehended a few but some others succeeded in escaping away. Learned Counsel for the petitioner submits that neither the petitioner was apprehended on the spot nor any incriminating material was recovered from his possession, the recovery is from other co-accused persons, the petitioner has no criminal antecedent and only material is disclosure of his name in the confessional statement of other accused and the police constable. Having considered the said facts and circumstances, the petitioner, namely, Ranjan Manjhi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Munger in connection with Kotali PS Case No. 359 of 2017.
