Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 11.9.2017 passed in Cr. Misc. No.39334 of 2017 and the petitioner was made accused on the confessional statement.

Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against the petitioner and the mobile which is said to be of the petitioner is not of the petitioner and he is in custody since 5.1.2017 and up till now only four witnesses have been examined.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be

Patna High Court Cr.Misc. No.50146 of 2018 (2) dt.05-09-2018 2/2 enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ XIth, Saran at Chapra in connection with S.Trial No.315 of 2017 (Arising out of Dariyapur P.S.Case no.320 of 2016), Saran at Chapra with condition that one he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
