The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 302, 201 of the Indian Penal Code.
Informant suspects that due to illicit relationship of her husband with co-accused Rabita Devi, he has been killed by all the F.I.R. named accused persons including this petitioner. It is submitted on behalf of petitioner that petitioner is not named in the F.I.R. Name of the petitioner transpired during course of the investigation on the basis of confessional statement of co-accused Rabita Devi. The only material, which has come against the petitioner, is that this petitioner is brother of co-accused Rabita Devi, with whom, deceased had illicit relation. Save & except suspicion, there is no other material against this petitioner to show his complicity in the alleged crime. Petitioner has got clean antecedent.
Patna High Court CR. MISC. No.69958 of 2022(4) dt.09-05-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Kaimur at Bhabua in connection with Kudra P.S.
