JUSTICE SANJAY PRIYA ORAL ORDER 01-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Ujiyarpur P.S. Case No. 8 of 2018 instituted for the offence under Sections 380, 414 and 457 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is in custody since 4.1.2018. There is no recovery from his possession. He has been implicated in this case on account of land dispute. It is alleged in the written report that on the date of occurrence, informant was sleeping in her house. She heard sound of a person in her Angan, upon which, she opened the gate and saw one person standing in the Angan. He tried to run away. She raised hulla and then he was caught by the villagers. The informant identified him as petitioner. It is further alleged that some utensils were found missing from the house.
Patna High Court Cr.Misc. No.49812 of 2018 (2) dt.01-10-2018 2/2 Counsel for the petitioner submits that there is no recovery from possession of the petitioner. It has further been submitted that co-accused Santosh Kumar with similar allegation has already been granted bail by a coordinate Bench of this Court vide order dated 03.08.2018 passed in Cr. Misc. 43791 of 2018 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dalsinghsarai, Distt. Samastipur, in connection with Ujiyarpur P.S. Case No. 8 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
