JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-08-2024 The present writ petition has been filed seeking the following relief:- "1. For direction to the Deputy Secretary, in-Charge, JP Senani Samman Yojna Home (Special) Department, Bihar, Patna to pay JP Senani Samman Pension to the petitioner with effect from 11.05.2017 as he remained in custody from 04.10.1974 to 27.11.1974 in connection with Gobindganj PS Case No. 2(10)/ 1974 lodged under sections 141, 142, 143 and 188 of the Indian Penal Code and Section 69 of the DIR arising out of JP movement."

At the outset, the learned counsel for the petitioner submits that the petitioner has filed

Patna High Court CWJC No.17668 of 2023(3) dt.28-08-2024 2/2 an application in the proper format on 11.05.2017 before the Deputy Secretary, In-Charge, JP Senani Samman Yojna, Home (Special) Department, Bihar, Patna, for grant of JP Senani Samman Pension, however, the same has not been disposed off yet, hence, the Secretary, Home (Special) Department, Bihar, Patna, be directed to dispose off the said application within a stipulated time frame.

Having regard to the limited prayer made by the petitioner in the present case, I deem it fit and proper to direct the respondents to consider the aforesaid application filed by the petitioner, in case the same has actually been filed and is still pending consideration and pass a reasoned and a speaking order in accordance with law, within a period of eight weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
