The petitioner is in custody since 13.08.2019 in connection with Kamtaul P.S. Case No. 121 of 2019 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but from the shop which is also being frequented by other family members. It is further submitted that the petitioner has no criminal antecedents.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand)

Patna High Court CR. MISC. No.65452 of 2019(2) dt.25-10-2019 2/2 with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, II cum Special Judge, Excise Act, Darbhanga in connection with Kamtaul P.S. Case No. 121 of 2019.
