Heard learned counsel for the petitioners No.1 and 3 to 6 and learned APP for the State.
The petitioners No.1 and 3 to 6 are apprehending their arrest in a case registered under Sections 302/34 of the Indian Penal Code.
Patna High Court Cr.Misc. No.52869 of 2018(2) dt.17-09-2018 2/3 The prosecution case, in short, is that the accused persons including the petitioners committed murder of the daughter of the informant.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The name of the petitioners has transpired in the present case merely on the basis of suspicion. There is no eye witness to the alleged occurrence nor there is any other substantive evidence to suggest the implication of the petitioners in the present case. The petitioners are the in-laws of the deceased. The alleged occurrence is said to have taken place after 16 years of marriage. The petitioners have got no concern with the alleged occurrence.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners No.1 and 3 to 6, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned
