JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-08-2018 The petitioner is apprehending his arrest in connection with Rail Jhajha P.S. Case No. 206/2017, registered for offences punishable under Sections 328, 307 and 379 of the Indian Penal Code.

Petitioner is said to be the member Nashakhurani gang and it is alleged that petitioner offered some intoxicating drink to the informant and after consuming the same, informant became unconscious and the petitioner said to have looted away Rs. 9,000/- and other belongings.

Submission of learned counsel for the petitioner is that earlier also a similar case has been lodged by the informant at Howrah (West Bengal), in which the petitioner has been granted bail. Further submitted that the petitioner has been falsely

Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner.

Having heard both sides, in view of the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender before the court below within a period of six weeks and pray for regular bail and if any such application is filed, the court below shall consider the submission of learned counsel for the petitioner that with respect to the same occurrence, two cases have been filed and in one of the cases, he has been granted the privilege of anticipatory bail and after considering, the same, the court below shall dispose of the prayer for regular bail of the petitioner, without being prejudiced by the order of this Court.
