1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Bhabhua P.S. Case no. 743 of 2023 registered under sections 420, 419 and 409 of the Indian Penal Code.

3. As per the prosecution case, it is stated that on secret information having been received a raid was conducted and it transpired that without any authorization by the competent authority, the accused persons were carrying out official work in a private residence.

4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The reason for his false implication is that allegedly some of the documents related to the petitioner who happens to be the Halka kramchari was

Patna High Court CR. MISC. No.73548 of 2024(2) dt.29-10-2024 2/2 found from the rented premises. It is submitted that no offence has been committed by the petitioner who was also proceeded against departmentally and punished. The petitioner has no criminal antecedent.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R. together with the petitioner not having any criminal antecedent, it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bhabhua P.S. Case no. 743 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua.
