JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-04-2024 The present writ petition has been filed seeking the following relief:- "1. The present writ petition is being filed for issuance of appropriate writ or writs, direction or directions, order or orders directing the respondents to give financial benefits to the petitioner of 2nd Time Bound Promotion and accordingly fix his pension from the date the petitioner is entitled."

At the outset, the learned counsel for the

Patna High Court CWJC No.15236 of 2023(2) dt.02-04-2024 2/2 petitioner submits that the arrears of salary on account of grant of second time bound promotion has already been paid to the petitioner, after filing of the present writ petition, however, the effect of the same has not been taken into account as far as fixation of pension is concerned, hence the respondent be directed to do the needful with regard to re-fixing the pension of the petitioner.

Having regard to the limited prayer made by the petitioner in the present writ petition, I deem it fit and proper to direct the respondent no.4, i.e. the Executive Engineer, Road Construction Department Road Division, Jamui to re-fix the pension of the petitioner by taking into account the effect of grant of second time bound promotion, within a period of four weeks of receipt/production of a copy of this order. 3.

The writ petition stands disposed off on the aforesaid terms.
