JUSTICE BIRENDRA KUMAR ORAL ORDER 17-09-2019 This application under Section 482 Cr.P.C. has been preferred against order granting ad interim maintenance in a proceeding under Section 125 Cr.P.C. by the learned Principal Judge, Family Court, Munger.

A Division Bench of this Court in Md. Akil Ahmad Vs. The State of Bihar reported in 2016(4) PLJR page 968 has held that an application under Article 227 of the Constitution of India shall be maintainable and not this application under Section 482 Cr.P.C.

Hence, the petitioner may convert this application into an appropriate application within two weeks.
