"The present application has been preferred for invoking the contempt jurisdiction of this Court so that proceedings of contempt may be initiated against the opposite party no.7 for willful and deliberate defiance of the order dated

Patna High Court MJC No.3605 of 2017(3) dt.17-12-2019 2/2 25.01.2017 passed by the Division Bench in C.W.J.C.No. 12190 of 2015 whereby the opposite party no.7 was directed to take appropriate action and submit a report under section 173 of the Code of Criminal Procedure within six months in pertaining to investigation of Kishanganj P.S. Case No. 257 of 2015." This application, instituted on 14.12.2017, has come up for hearing before this Court today for the first time. Learned counsel for the petitioner seeks permission to withdraw this petition for the reason that it has become infructuous.
