2. The petitioner seeks regular bail in connection with Patarghat P.S. Case No.125 of 2024 lodged dated 18.06.2024 under Sections 25(1-A), 25(1-B), 25(1-AA), 25(1-B)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, the F.I.R. has been lodged against three named accused persons including the petitioner against whom there is allegation of recovery of materials for construction of arms in the seizure list.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner has not been arrested from the place of occurrence. As such, there is no recovery from his possession.

5. Learned Counsel further submits that the petitioner has been made accused in this case only by virtue of confessional statement of other apprehended persons, who are not corroborative in nature.

6. Learned Counsel further submits that petitioner is in custody since 10.07.2024 having clean antecedent.

7. Learned counsel for the State opposes the prayer for bail.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Patarghat P.S. Case No.125 of 2024, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.
