JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-09-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, in the present case, is seeking regular bail in connection with Jankinagar P.S. Case No. 136 of 2016 arising out of CIS No. 382 of 2018 registered for offences alleged under Sections 341, 323 and 364 (A)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report, however, his name has transpired in the confessional statement of one Mantu Kumar Yadav. It is submitted that Mantu Kumar Yadav has already been granted bail by a learned Coordinate Bench of this Court, moreover, even the named accused Bablu Yadav and Gopal Yadav have been granted privilege of regular bail in Cri. Misc. No. 4984

Learned APP for the State is present and has opposed the prayer for bail.

Considering the facts and circumstances of the case, wherein the name of this petitioner seems to have transpired on the confessional statement of Mantu Kumar Yadav who has earlier been granted bail and further it is stated that the petitioner has got no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnia, in connection with Jankinagar P.S. Case No. 136 of 2016 arising out of CIS No. 382 of 2018 subject to the conditions U/S 437(3) Cr.P.C.
