2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3 . As per F.I.R., 1926 liters of foreign liquor has been recovered from the seized truck .

4. Learned counsel for the petitioner submits that petitioner is not the owner of the vehicle in question and has been made accused in this case only on the basis of suspicion . No incriminating article has been recovered from the conscious possession of petitioner. Petitioner has got two criminal antecedents out of which one is of similar nature and in both cases he is on bail.

Patna High Court CR. MISC. No.68710 of 2025(2) dt.08-12-2025 2/2 5 . Learned A.P.P. for the State has opposed the bail petition .

6. Considering the aforesaid facts & circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 3, Motihari, East Champaran, in connection with Mehsi P.S. Case No. 84 of 2025, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure .
