JUSTICE SANJAY PRIYA ORAL ORDER 25-09-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Jokihat P.S. Case No. 376 of 2017 instituted for the offence under Sections 395, 397 of the Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that First Information Report is against unknown. The name of petitioner has come in the confessional statement of co-accused Md. Jahangir and Nasim who have already been granted bail by a coordinate Bench of this Court vide order dated 18.05.2018 passed in Cr. Misc. 24611 of 2018 along with Cr. Misc. 24630 of 2018. Counsel for the petitioner further submits that petitioner is in custody since 29.05.2018.

It is mentioned in paragraph-3 of the bail petition that

Patna High Court Cr.Misc. No.48730 of 2018 (2) dt.25-09-2018 2/2 petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Jokihat P.S. Case No. 376 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
