The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498A, 341, 323, 504, 506 and 34 of the Indian Penal Code. Despite valid service of notice, no one is appearing on behalf of the informant.
The learned counsel for the petitioner submits that petitioner, being the husband, has been falsely implicated in the present case, it is next submitted that earlier also the informant had instituted a case under Section 498A read with other sections of the IPC wherein the petitioner was taken in judicial custody, but after trial he was acquitted. It is further submitted that after acquittal again the informant has instituted the present
Patna High Court CR. MISC. No.68581 of 2022(3) dt.24-06-2023 2/2 false case. It is next submitted that the informant is in habit of falsely implicating the petitioner.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Supaul Mahila P.S. Case No. 64 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
