2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 467, 468, 471, 420, 120B of the Indian Penal Code and Sections 30(a), 32(i)(ii)(iii), 36, 41(i) (ii)(iii) of Bihar Prohibition & Excise Act, 2016-18.

3. As per the prosecution case, the informant along with other police personnel raided the fertilizer godown of the petitioner and saw that one Truck and three pickup van are standing there loaded with huge quantity of liquor. The police team seized total 7238.160 litre of foreign liquor from the above vehicle and arrested three persons from the spot. The arrested persons were the driver of the truck and the labourers.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that there is no recovery from the conscious

He further submits that the petitioner is the owner of the godown and let out the godown to one Satish Kumar on 01.09.2023 vide a rent agreement, a copy of the rent agreement is enclosed as Annexure-P/2 to this application. He also submits that the petitioner has business of godown and rented house and has let out his so many godowns to several persons. Petitioner has one criminal antecedent as mentioned in para-3 of this application.

5. Learned APP for the State opposes prayer for anticipatory bail.

Considering the facts and circumstances of the case and there is admitted fact that the petitioner has given the said godown to one Satish Kumar, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Muzaffarpur Sadar P.S. Case No. 903 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
