ANJANA MISHRA ORAL ORDER 05-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 15.08.2019 in connection with Special Case No.7265 of 2019, arising out of Alamganj P.S. Case No.589 of 2019, registered for the offence under Sections 419, 420, 290 of the I.P.C. and Section 3⁄4 of the Lottery Regulation Rules and Section 37(c) of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that a bare perusal of the F.I.R. does not reveal any offence under Sections 419, 420 and also 290 of the I.P.C. So far as the provisions of the Excise Act are concerned, nothing was recovered from his conscious possession. Learned counsel for the petitioner further
Patna High Court CR. MISC. No.78743 of 2019(3) dt.05-12-2019 2/2 submits that save and except one other case under the Excise Act, the petitioner has no criminal antecedents. Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Special Judge, Excise, Patna, in connection with Special Case No.7265 of 2019 arising out of Alamganj P.S. Case No.589 of 2019.
